DMCA Policy
Ceviche respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our Designated Copyright Agent, identified in the sample notice below.
This policy describes the information that should be present in a notice of copyright infringement and the steps for submitting such a notice. It also outlines the process for filing a counter-notification if your content has been removed due to an alleged copyright infringement.
Filing a DMCA Notice of Copyright Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written notice containing the following information (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- Identification of the copyrighted work claimed to have been infringed: This must include a description of the copyrighted work that you claim has been infringed.
- Identification of the infringing material: A description of the material that you claim is infringing and sufficient information to permit us to locate the material on our site (e.g., specific URLs or links to the content).
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy and under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes substantially the following:
- Identification of the material removed: Identification of the material that has been removed or to which access has been disabled, and the location (e.g., URL) at which the material appeared before it was removed or access to it was disabled.
- A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, and telephone number.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Ceviche may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
- Your physical or electronic signature: Your physical or electronic signature.
